These Terms and Conditions govern access to and use of sangamify.com and related Sangamify services.

1. About Sangamify

Sangamify is an independently operated online platform.

By creating an account, publishing a listing, making a booking or otherwise using Sangamify, you agree to these Terms.

If you use Sangamify for an organization or business, you confirm that you have authority to act on its behalf.

2. Definitions

  • "Sangamify," "we," "us" or "our" means the operator of the Sangamify platform.
  • "User" means anyone who visits or uses the platform.
  • "Organizer" means a person or organization publishing or managing an event.
  • "Provider" means a person or organization offering a service.
  • "Customer" means someone who books, purchases or enquires about an event, ticket, stall or service.
  • "Listing" means an event, stall, provider or service listing.
  • "Content" means text, photographs, logos, messages and other material submitted to Sangamify.

3. Sangamify's role

Sangamify provides technology that helps users discover and communicate with independent organizers and providers.

Unless expressly stated otherwise:

  • Sangamify is not the organizer, owner or operator of listed events;
  • Sangamify does not perform the services advertised by providers;
  • The organizer or provider is the customer's contractual counterparty;
  • Organizers are responsible for their events, tickets, stalls and attendees;
  • Providers are responsible for their services and conduct; and
  • Sangamify is not a party to agreements between customers and organizers or providers.

Providing listing, communication, booking or payment tools does not make Sangamify responsible for performing the underlying event or service.

If Sangamify collects a payment on behalf of an organizer or provider, it acts only as a payment intermediary unless the checkout expressly states otherwise. This section must be updated if Sangamify itself becomes the seller.

Nothing in these Terms excludes responsibilities that cannot legally be excluded.

4. Accounts

Users must:

  • Provide accurate and current information;
  • Keep login credentials secure;
  • Avoid impersonating another person or organization;
  • Use their accounts only for lawful purposes; and
  • Notify Sangamify promptly about suspected unauthorized access.

Users are responsible for activity performed through their accounts unless that activity resulted from a security failure for which Sangamify is legally responsible.

5. Organizer responsibilities

Organizers are responsible for:

  • Accurate event dates, times and venue details;
  • Event descriptions, schedules and accessibility information;
  • Ticket prices, fees and limits;
  • Stall sizes, positions, facilities and conditions;
  • Required permissions, licences, insurance and safety measures;
  • Venue, crowd, food, alcohol and emergency arrangements;
  • Employees, performers, contractors, volunteers and stallholders;
  • Honouring confirmed tickets and stall bookings;
  • Communicating changes, postponements and cancellations;
  • Handling attendee and stallholder questions;
  • Providing required cancellations or refunds;
  • Taxes, invoices, royalties and other charges;
  • Protecting personal information;
  • Obtaining permission for photographs, logos and other content; and
  • Complying with applicable consumer, safety and anti-discrimination laws.

An organizer must not claim that Sangamify organizes, sponsors, endorses or guarantees an event unless Sangamify has agreed in writing.

6. Provider responsibilities

Providers are responsible for:

  • Accurate profiles, pricing and availability;
  • Correctly describing whether they act professionally or privately;
  • The legality, quality and safety of their services;
  • Required qualifications, permissions and insurance;
  • Agreeing the scope, timing, location and price with customers;
  • Performing confirmed services;
  • Providing invoices where required;
  • Taxes, cancellations and refunds;
  • Protecting customer information;
  • Their employees, assistants and subcontractors; and
  • Ensuring claims, credentials, photographs and reviews are genuine.

A profile or verification indicator is not a guarantee of quality, safety, qualifications or future performance.

Customers must make their own assessment before engaging a provider.

7. Professional and private providers

Sangamify may allow both professional providers and private individuals to publish services.

Each provider must correctly declare its status.

Professional providers may be required to submit identity, contact, payment, registration or other verification information where applicable.

Private individuals must not represent themselves as registered professionals or businesses. Where required, customers will be informed that consumer protections applicable to purchases from businesses may not apply to a transaction with a private individual.

Providers are responsible for determining whether their activities require business registration, tax reporting, licences, insurance or other formalities. Sangamify does not provide tax or business-registration advice.

Sangamify may reclassify, restrict or suspend a provider if its declared status appears inaccurate or misleading.

8. Customer responsibilities

Customers must:

  • Review listing details and applicable conditions;
  • Provide accurate booking and contact information;
  • Pay disclosed prices and fees;
  • Follow reasonable venue and safety rules;
  • Communicate respectfully;
  • Use tickets and bookings only as permitted;
  • Contact the organizer or provider about performance or refunds; and
  • Avoid fraudulent bookings, chargebacks or platform misuse.

9. Event tickets and stalls

A contract for an event ticket or stall is formed between the customer and organizer when the booking is accepted or confirmed.

The organizer is responsible for:

  • Delivering the event;
  • Providing access corresponding to the ticket;
  • Providing the booked stall or an agreed alternative;
  • Accepting or rejecting booking requests;
  • Communicating event changes;
  • Resolving booking disputes; and
  • Providing cancellations or refunds required by law or its published conditions.

Sangamify does not guarantee that an event will occur or that a particular venue, performer, stall, activity or facility will be available.

10. Provider enquiries and bookings

Unless expressly stated otherwise, a request submitted through Sangamify is an enquiry and does not guarantee acceptance.

The customer and provider must agree:

  • The precise service;
  • Date, time and location;
  • Price and additional costs;
  • Payment arrangements;
  • Cancellation conditions; and
  • Any special requirements.

Sangamify is not responsible for disagreements concerning the quality, suitability, timing or completion of a provider's service.

11. Payments and refunds

Prices and mandatory fees must be disclosed before a customer confirms a paid booking.

Sangamify does not currently process payments directly. Payment for a ticket, stall or service is arranged between the customer and the organizer or provider. If online payment processing is introduced in the future, this section will be updated to name the payment provider and its terms.

Unless Sangamify is expressly identified as the seller:

  • The organizer or provider establishes its cancellation policy;
  • The organizer or provider is responsible for legally required refunds;
  • Sangamify may facilitate a refund on the seller's instructions;
  • Sangamify may recover amounts relating to refunds, disputes, fraud or chargebacks; and
  • Sangamify's own fees are refundable only as disclosed and legally required.

Nothing in these Terms creates a blanket no-refund rule or limits mandatory consumer rights.

12. Content responsibility

Organizers and providers are responsible for all Content they submit.

By submitting Content, you confirm that:

  • It is accurate and current;
  • You own it or have permission to use it;
  • It is not misleading;
  • It does not violate privacy or intellectual-property rights;
  • It is not illegal, defamatory or discriminatory;
  • It does not promote unsafe or prohibited activities;
  • It complies with advertising and consumer rules; and
  • You have permission to publish identifiable people's images or information.

You retain ownership of your Content.

You grant Sangamify a non-exclusive, worldwide and royalty-free licence to host, reproduce, format, translate, display and distribute the Content for operating and promoting the platform and relevant listing.

13. Verification

Sangamify may request identity, contact, professional or other supporting information.

Verification means only that Sangamify performed the checks it describes. It is not:

  • An endorsement;
  • A professional certification;
  • A guarantee of quality;
  • A guarantee of safety; or
  • A guarantee that information will remain accurate.

Organizers and providers must update changed or expired information promptly.

14. Prohibited conduct

Users may not:

  • Publish false, copied or unauthorized listings;
  • Misrepresent their identity, status or qualifications;
  • Offer illegal, counterfeit or unsafe products or services;
  • Infringe privacy or intellectual-property rights;
  • Publish malicious software;
  • Attempt unauthorized system access;
  • Harvest user information;
  • Send unsolicited marketing;
  • Manipulate bookings, rankings or reviews;
  • Publish fake reviews;
  • Discriminate unlawfully;
  • Engage in fraud or harassment; or
  • Use Sangamify for illegal activities.

15. Reporting content

Potentially illegal, unsafe or prohibited content may be reported to info@sangamify.com.

Reports should include:

  • The relevant page or listing;
  • A clear explanation of the concern;
  • Supporting information where available;
  • The reporter's contact information, unless anonymity is legally permitted; and
  • A statement that the report is accurate and submitted in good faith.

Sangamify may investigate, restrict or remove reported Content.

Sangamify does not guarantee that every listing will be reviewed before publication. However, Sangamify may act when it becomes aware of illegal, unsafe or prohibited Content.

16. Search order and promoted listings

Listings may be ordered using factors such as:

  • Relevance;
  • Location;
  • Date and availability;
  • Category;
  • Listing completeness;
  • Verification status;
  • Popularity;
  • Recency; and
  • Promotional status.

Paid placements will be identified where applicable.

17. Suspension and termination

Sangamify may restrict a listing, booking function or account because of:

  • A breach of these Terms;
  • Inaccurate or misleading information;
  • Safety or legal concerns;
  • Suspected fraud;
  • Repeated complaints;
  • Payment disputes;
  • Intellectual-property violations;
  • Misuse of personal information; or
  • A lawful request from an authority.

Where required, Sangamify will provide the affected user with an explanation and an opportunity to submit a complaint.

Immediate restriction may be necessary for urgent safety, legal, fraud or security reasons.

18. External services

Sangamify may link to mapping, payment, social-media, organizer or provider websites.

Those services are independently operated. Sangamify is not responsible for independent third-party systems, content or services.

19. Availability

Sangamify aims to provide a reliable platform but does not guarantee uninterrupted or error-free operation.

Features may be modified, maintained or suspended where reasonably necessary.

20. Liability

Organizers and providers—not Sangamify—are responsible for their listings, events, services, products, personnel and contractual obligations.

To the maximum extent permitted by law, Sangamify is not liable for:

  • Event cancellations, postponements or inaccurate information;
  • Denied entry or attendee conduct;
  • Venue, food, crowd or physical-safety incidents controlled by third parties;
  • A provider's quality, conduct or failure to perform;
  • User-submitted Content;
  • Organizer or provider refund obligations;
  • Loss or damage caused by another user; or
  • Independent websites or services.

For professional users, Sangamify's total liability relating to the platform will be limited, where legally permitted, to the greater of:

  • Fees paid to Sangamify by that user during the preceding 12 months; or
  • €1,000.

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms limits mandatory consumer rights.

21. Professional-user indemnity

To the extent permitted by law, an organizer or professional provider must compensate Sangamify for reasonable losses and claims resulting from:

  • Its event, products or services;
  • False or unlawful Content;
  • Its breach of these Terms;
  • Violation of another person's rights;
  • Misuse of personal information; or
  • Failure to obtain required permissions, licences or insurance.

This provision does not apply to private consumers where it would unlawfully restrict consumer rights.

22. Complaints

Customers should first contact the relevant organizer or provider about an event, service, cancellation or refund.

Complaints concerning Sangamify may be sent to info@sangamify.com. Include the relevant account email, listing or booking reference and requested resolution.

Sangamify may help the parties communicate but is not required to decide contractual disputes between them.

23. Changes

Sangamify may update these Terms for legal, security, operational or service-related reasons.

Material changes will be communicated where required. Professional users will receive appropriate advance notice unless a shorter period is legally permitted for urgent legal, fraud or security reasons.

24. Applicable law

These Terms are governed by Dutch law.

Disputes will be handled by the competent Dutch courts, except where mandatory consumer law permits a consumer to bring proceedings elsewhere.

If one provision is unenforceable, the remaining provisions remain effective.
